Seven days after the temporary restraining order, Ali signed a seven-page order in both cases. Global Health ECF 28, filed February 20, 2025. RECAP PDF verified. The AIDS Vaccine plaintiffs had moved to enforce the TRO and to hold defendants in civil contempt.
He granted the motion in part. Quote, verified: “Plaintiffs’ motion is granted in part, insofar as Defendants have continued their blanket suspension of funds pending review of agreements, the very action that the TRO enjoined.” He ordered that, to the extent the blanket suspension continued, defendants “immediately cease it and … take all necessary steps to honor the terms of contracts, grants, cooperative agreements, loans, and other federal foreign assistance awards that were in existence as of January 19, 2025, including but not limited to disbursing all funds payable under those terms.”
He denied contempt. Quote, verified: “the Court finds that contempt is not warranted on the current record and given Defendants’ explicit recognition that ‘prompt compliance with the order’ is required.” He also wrote that the TRO does not restrain individualized action on a particular agreement where the agency determines it has lawful authority, and that it does not permit a new blanket directive under a new legal label.
He set the TRO to expire at 11:59 p.m. on March 10, 2025, or when he resolved the preliminary-injunction motions, whichever was sooner. A later enforcement order on February 25 is a different document. It is not this one.
